Terms and Conditions
Historic Battlefield Tours offer guided trips to various battlefield; conflict and historical sites throughout Scotland. By booking a trip with us you are agreeing to the following terms and conditions.
1. What Is Included
The trip you are booked on will include –
a) Pick up from an arranged location.
b) Guided tours of the sites you will be visiting.
c) Travel between the various sites.
d) Drop off at an arranged location.
2. What Is Not Included
a) Travel to and from your accommodation to the central pick up/drop off point unless previously arranged.
b) Meals.
c) Accommodation.
3. Tour Booking Fee
The full cost of the tour you are booking is payable in advance by –
a) With more than 2 days notice before the tour begins – Either by a cheque drawn on a UK bank, Faster Payments Transfer, International Bank Transfer or Paypal. Please note that although we will acknowledge receipt of your payment by email as soon as we receive it, we will not confirm your tour until payment has cleared.
b) With less than 2 days notice before the tour begins - Contact us to check availability and arrange another payment method.
Please ensure that you have read and understood our Cancellation and Amendment Policies below before booking your tour. If you have any questions relating to our policies; please contact us before booking.
4. Tour Costs Guarantee
a) Once you have booked a specific tour, the price you have paid is guaranteed. You will not be charged any additional fees unless they are related to amendments you have requested.
5. Amendments to Your Tour by Historic Battlefield Tours
a) Historic Battlefield Tours reserve the right to make minor amendments to your tour schedule. Where these amendments are the result of an act or actions not attributable to Historic Battlefield Tours, we will offer alternatives to your schedule. Should the amendments occur due to any act or actions which can be attributed to Historic Battlefield Tours such as illness of your driver/guide or vehicle failure we will offer alternatives to your schedule or a refund on that part of your schedule which has to be amended.
6. Amendments to Your Tour by You
In the event that you wish to make an amendment to the tour you have booked the following conditions will apply –
a) You wish to transfer your tour: i.e. you or a member of your party is unable to make the tour and you want to transfer the booking to someone else. Where this amendment has been requested you are required to notify us in advance of the tour in writing (emails are acceptable; however, these must include an electronic signature, guidance on how to create an electronic signature is available freely by searching the internet. The email address must be the same as the one on your booking form). We also require the names of those to be changed and proof of their insurance. There will be no charge applied for this type of change; however, please note that we will not offer a refund to the original named person for this service.
b) You wish to make an addition to the number of people booked on your tour: i.e. instead of the two people you had originally booked the tour for; you want to make the booking for three. Where this amendment has been requested simply book the additional person(s) on your tour as normal. Please note that this amendment is subject to availability of places on your selected tour.
c) You wish to make a reduction in the number of people booked on your tour: i.e. instead of the three people you had originally booked you want to make the booking for two. Where this amendment has been requested you can cancel the individual bookings using the process below.
7. Cancellation of Your Tour by Historic Battlefield Tours and Refund Policy
a) In the unlikely event that Historic Battlefield Tours have to cancel your tour we will contact you by email or telephone as soon as this becomes known to us. Should this occur, we will offer alternatives to your tour or a full refund of the cost of the tour minus any bank charges we have incurred as a result of receiving and returning your payment that you have paid to us. In all cases evidence of these charges will be provided to you.Historic Battlefield Tours will not accept liability for any accommodation or travel costs over and above the cost of the tour you have paid us.
8. Cancellation of Your Tour by You and Our Refund Policy
In the event that you wish to cancel the tour you have booked for any reason the following conditions will apply:
a) You must notify us in writing that you wish to cancel the tour (emails are acceptable; however, these must include an electronic signature, guidance on how to create an electronic signature is available freely by searching the internet. The email address must be the same as the one on your booking form).
b) Refunds will be made on receipt by Historic Battlefield Tours of a written cancellation notice; not the date of your notification (unless it has been communicated to us by email) and will be made on the following basis:
i. Receipt of written cancellation with more than 21 days notice of cancellation – The payment you have made to us minus any bank charges we have incurred as a result of receiving and returning your payment. In all cases evidence of these charges will be provided to you.
ii. Receipt of written cancellation with less than 21 days notice of cancellation – no refund.
Please be advised that your travel or holiday insurance may refund any cancellation charges levied by us and you are encouraged to check their terms and conditions to see if you are covered should this occur.
9. Your Responsibilities
By booking a tour with Historic Battlefield Tours you are confirming:
a) That you are entering into a contract with Historic Battlefield Tours which is subject to Scottish Law and which can only be pursued through a Scottish Court.
b) That if you are from outside the UK you will be in possession of the relevant passport and visas or EU identification needed for your visit to the UK.
c) That you will have comprehensive travel or holiday insurance. Details of this insurance must be provided to Historic Battlefield Tours before your tour starts.
d) That you are medically and physically fit enough to undertake the tour.
e) That you are responsible for ensuring that all booking details, including any passengers’ names and emergency contact details are correct.
f) That you are responsible for the conduct and behaviour of your party.
Please be advised that Historic Battlefield Tours reserves reasonable discretion to exclude you or any member of your party from further participation in the tour if you or their conduct is disruptive, dangerous, abusive or annoying to others: in this instance Historic Battlefield Tours will take no further responsibility for the excluded person/s (including transport) and will not be held liable for a full or partial refund on any part of the tour which has been lost.
10. Personal Belongings
a) Historic Battlefield Tours will not accept liability for personal belongings lost or stolen on the tour. Neither will they accept liability for any personal belongings which have been left on the transport and are lost or stolen. Your personal belongings are your responsibility and you are therefore advised to bring a small rucksack/daysack to ensure that your personal belongings remain with you during the tour.
11. Our Responsibilities to You
a) Historic Battlefield Tours are responsible for providing all aspects advertised on their website or agreed with you in writing as being part of the Tour you have been booked on.
b) Historic Battlefield Tours will not use your personal or financial data for any reason other than booking your tour and will not under any circumstances pass your details onto a third party unless required to do so by the Police or Legal Request. You will be informed if we have had to provide this information and to whom we have provided it.
c) Historic Battlefield Tours reserves the right to refuse to accept a booking at our discretion.
d) Historic Battlefield Tours will not accept liability for any injury to you, damage to your personal belongings or additional expenses you have incurred which are the result of unforeseen circumstances which could not have been avoided, even if all due care and attention has been exercised. For example;
i. Any injury to you, damage to your personal belongings or additional expense to you which has occurred as a result of an act or actions which can be personally attributed to you.
ii. Any injury to you, damage to your personal belongings or additional expense to you which has occurred as a result of an act or actions which can be attributed to third party unconnected with the provision of the tour.
iii. Any injury to you, damage to your personal belongings or additional expense to you which has occurred as a result of an act or actions which can be attributed to war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster or fire.
